Services relating to Employment Law for Senior Executives and Employers
- Drafting and settling employment agreements in relation to remuneration, conditions, incentive schemes and bonus entitlements;
- Advising on the management of issues arising between employers and senior executives during employment;
- Advising on the proper management or resolution of issues relating to the termination of employment;
- Advising on and negotiating terms of settlement and release on termination including in respect of payments in lieu of notice, restraint obligations, accrued leave entitlements and good leaver status issues relevant to bonus payments and vesting of long term incentive payments;
- Requesting private rulings from the Australian Taxation Office on behalf of executives in relation to the proper characterisation and tax treatment of termination payments including redundancy payments and, where necessary, making application to the Administrative Appeals Tribunal or the Federal Court to review the ATO assessment of same;
- Conducting litigation in relation to unresolved employment issues, primarily in the Supreme Court of Victoria, County Court of Victoria, Federal Court of Australia as well as in appellate Courts.
